The whole point of the sidewalk comparison is that there is an easement on the sidewalk. You OWN the sidewalk. But you can't keep people off of it. Why? Because there's an easement - public access. Does that mean a person can come snooping around your yard? Of course not. Are you going to have the occasional dog crap on your lawn? Probably, but that's illegal. The same thing goes with water! Do you own the land? Yup. Can you (or legally should you) be able to keep people off of it? NO! Why? It's the same thing as the sidewalks, an easement exists. Honestly, yes, there will probably be those who abuse it (like the defecating dogs) but that doesn't mean it's legal. Since when do the illegal actions of a few punish the rest of the law abiders? This is bad medicine and unconstitutional.
