SUNDAY HUNTING OPTIONS

HUNTING General:

a. All Private lands require Landowner Permission. Written in the case of Deer and Turkey; verbal for other species.

b. State and Private lands require a Permit @ $14 for hunting Deer, Turkey and Pheasants; other species none, except waterfowl.

c. A landowner must have a minimum of 10 acres to authorize the use of a rifle for deer hunting.

d. Rifles or handguns using ammunition larger or heavier than .22 caliber rimfire long rifle cartridges are prohibited on state-owned land.

e. Hunting or shooting from or across the traveled portion of any public roadway is prohibited. Shooting toward any person, building, or domestic animal when within range is prohibited.

f. Landowners and Lineal Descendants - are exempt from the requirement to carry written permission while hunting deer or turkey on their own land.

g. It is prohibited to hunt with, shoot, or carry a loaded firearm within 500 feet of any building occupied by people or domestic animals, or used for storage of flammable material, or within 250 feet of such buildings when waterfowl hunting in tidal areas from land shooting positions or from floating blinds anchored adjacent to land or from rock positions, unless written permission for lesser distances is obtained from the owner and carried. Landowners, their spouse, and lineal descendants are exempt from this restriction, providing any building involved is their own.

h. During the period September 1 through the last day of February, hunters are required to wear at least 400 square inches of fluorescent orange clothing above the waist and visible from all sides. The following hunters are exempt from this requirement: Archery Deer Hunters during most seasons, Archery and Firearms Turkey Hunters, Waterfowl Hunters while hunting from boats, duck blinds, or other stationary positions, Crow Hunters while hunting from blinds or a stationary position, Raccoon and Opossum Hunters when hunting from 1/2 hour after sunset until 1/2 hour before sunrise, and Landowners while hunting deer on their own property. Family members are still required to wear fluorescent orange. Persons hunting with deer damage permits are also subject to the fluorescent orange requirement.

i. In accordance with Connecticut General Statute 26-61, payment of a fine, forfeiture of a bond or a plea or judgement of guilty for a fishing, hunting, or trapping violation will result in the suspension of your fishing, hunting and trapping license.

Basic Provisions - ALL options:

a. PRIVATE LAND ONLY with a PERMIT ALLOWING THE ACTIVITY FROM THE OWNER, LESSEE, OR AGENT OF SUCH LAND. Does not impact on other recreationalists using State Forests, Parks, etc.

b. Special Sunday Hunting Permission required from landowner for Sunday Hunting.

c. Would apply statewide, all hunting implements, all species consistent with DEP wildlife management objectives and current policy. (A Hunting Implement Exception is Proposal #4.)

d. DOES NOT APPLY TO THE HUNTING OF MIGRATORY WATERFOWL. Federally regulated, Sunday Waterfowl Hunting would decrease activity by shortening seasons.

e. Other huntable species would not be seriously affected and any potential can be controlled through DEP wildlife management regulations.

f. Seasons would compress over a period of years due to better species management.

NOTE: A reasonable option might be to eliminate all Sunday hunting prohibitions and allow the Commissioner DEP the authority granted recently under PA 03-192 to properly manage wildlife ?consistent with professional wildlife management principles? and (6) regulating hunting seasons and bag limits for all harvestable wildlife species within Connecticut;? (Sections 26-3, 26-69)

NOTE: A $14 Special DEP Sunday Hunting Permit is supported with expected new State revenue approximating $1 million (See notes under Benefits). CT would be the first state to implement a special Sunday Hunting fee.



SUNDAY HUNTING Options



1. Repeal the Sunday Hunting Prohibition in its entirety.

a. Objective: Would allow hunting of all species, on both State and private land, and use of all hunting implements subject to current and future DEP wildlife management seasons and Regulatory standards.

b. Debate: Objections from other recreationalists on State lands based upon safety although there are very few non-hunting participant injuries documented.

c. Benefits: Repeal an antiquated ?Blue Law.? Maximize Permit fee revenue, if adopted.



1. Repeal the Sunday Hunting Prohibition ONLY on Private Lands.

a. Objective: Would allow hunting of all species, all seasons, Only on private land, and use of all hunting implements subject to current and future DEP wildlife management seasons and Regulatory standards.

b. Debate: Eliminates objections from other recreationalists due to landowner permission options (multiple use, no hunting).

c. Benefits: Addresses Private lands where wildlife management is most needed. Near maximization of Permit fee revenue, if adopted.

3. Allow Sunday Hunting in Seasons consistent with Deer wildlife management.

a. Objective: Would allow Sunday hunting on Private Land during the current Fall seasons when hunters and wildlife are most active. All seasons combined run from September 15 to January 31.

b. Debate: Limited participation by other recreationalists particularly during the latter dates of the seasons.

c. Benefits: Allows better management of all species consistent with current regulations, but primarily of Deer during a limited season when few people other than hunters are in the woods and wildlife is most active (Deer Rut). All hunting implements would be authorized subject to approval by the landowner (current standard). Near maximization of Permit fee revenue, if adopted.

c. New Days, Deer: Bowhunting 20; Shotgun/Rifle Private land 3; Shotgun/Rifle Landowner 8; Muzzleloader Private land 3.

4. Allow Sunday Hunting during a limited period November through January.

a. Objective: Would allow Sunday hunting, all species, on Private Land during November through January (part of the current season) when Deer are most active (partial Deer Rut). Would concentrate on firearms hunting (highest harvest) although bowhunters also participate during the period.

b. Debate: Few other recreationalists in the woods. Objection from bowhunters that part of their season would not include Sunday and that period is of high Deer harvest. DEP concerns that the impact would be to take more Deer than required from certain management zones. We believe current Deer tag limitations would control.

c. Benefits: Allows increased take primarily of Deer during a limited season when very few persons other than hunters are in the woods and wildlife is most active (Deer Rut). All hunting implements would be authorized subject to approval by the landowner (current standard). New Days, Deer: Bowhunting 13; Shotgun/Rifle Private land 3; Shotgun/Rifle Landowner 8; Muzzleloader Private land 3.

5. Allow Sunday Hunting during the current Bowhunting season only.

a. Objective: Allow ONLY Sunday Bowhunting on Private Land during the current season (September 15 through January 31).

d. Debate: Objections from other recreationalists based upon safety, although there has been NO bowhunting non-hunting participant injuries/fatalities documented. Reduces the significantly higher Deer harvest that could be achieved with firearms.

e. Benefits: Allows increased take primarily of Deer using the safest hunting implement. Permit fee revenue, if adopted, would be reduced by 70-75%.

d. New Days, Deer: Bowhunting 20.

PROPOSAL: SUNDAY HUNTING/FEE

Section 26-73 of the general statutes is repealed and the following is substituted in lieu thereof:

EXCEPT AS PROVIDED IN SUBSECTION (b) OF THIS SECTION, Sunday shall be a closed season except for the purpose of trapping under the provisions of this chapter. The possession in the open air on Sunday of any implement for hunting shall be prima facie evidence of hunting in violation of the provisions of this section. No provision of this section shall be construed so as to affect any provision of section 26-31, 26-48, 26-52, or 27-35 or apply to the use of bow and arrow for purposes other than hunting. Artificially propagated birds designated by the commissioner may be shot on Sundays on licensed private shooting preserves subject to such regulations of the commissioner as may apply to such private shooting preserves, provided permission so to shoot has been obtained from the town or towns within which such licensed shooting preserves are located.

NOTE: below is not THE proposal but a skeletal outline to be finalized.

(NEW) (b) HUNTING ON SUNDAY IS ALLOWED ON PRIVATE PROPERTY PROVIDED WRITTEN PERMISSION CONSENTING TO SUCH ACTIVITY SHALL BE OBTAINED FROM THE OWNER, LESSEE, OR AGENT OF SUCH LAND AND SUCH PERMISSION SHALL BE CARRIED BY ANY PERSON ENGAGED IN SUCH HUNTING. NO PERSON SHALL HUNT ON SUNDAY WITHOUT FIRST OBTAINING A SUNDAY HUNTING PERMIT FROM THE DEPARTMENT OF ENVIRONMENTAL PROTECTION. THE FEE FOR A SUNDAY HUNTING PERMIT SHALL BE FOURTEEN DOLLARS. THE PROVISIONS OF THIS SUBSECTION SHALL NOT APPLY TO THE HUNTING OF MIGRATORY WATERFOWL.

THIS ACT IS EFFECTIVE ON PASSAGE.

Sec. 26-73. Hunting on Sunday. Sunday shall be a closed season except for the purpose of trapping under the provisions of this chapter. The possession in the open air on Sunday of any implement for hunting shall be prima facie evidence of hunting in violation of the provisions of this section. No provision of this section shall be construed so as to affect any provision of section 26-31, 26-48, 26-52 or 27-35 or apply to the use of bow and arrow for purposes other than hunting. Artificially propagated birds designated by the commissioner may be shot on Sundays on licensed private shooting preserves subject to such regulations of the commissioner as may apply to such private shooting preserves, provided permission so to shoot has been obtained from the town or towns within which such licensed private shooting preserves are located. Basic Statute

Sec. 26-29c. Free private land deer permit for certain farmers. No Change needed.

Sec. 26-31. Instruction in handling and use of hunting weapons. Required education course for reinstatement of suspended license. (d) Any certified conservation education-firearms safety instructor while giving such instruction and any person scheduled to receive such instruction may possess and transport shotguns and rifles on Sunday and on said day may discharge such firearms on any state-owned property with prior approval of the agency controlling such property and on any privately-owned property with the permission of the owner, the provisions of section 26-73 to the contrary notwithstanding. Subsection can be removed.

Sec. 26-48. Private shooting preserves; permits; regulations. The commissioner may issue permits authorizing the establishment and operation of regulated private shooting preserves when in his judgment such preserves will not conflict with any reasonable prior public interest. The fee for such permit shall be fifty dollars per season. A hunting license shall not be required to hunt on such private shooting preserves. The commissioner shall govern and prescribe by regulations the size of the preserves, the methods of hunting, the species and sex of birds that may be taken, the open and closed seasons, the tagging of birds with tags furnished by the commissioner at a reasonable fee and the releasing, possession and use of legally propagated game birds thereon; and may require such reports as the commissioner deems necessary concerning the operation of such preserves. Any permit issued under the provisions of this section may be revoked for a violation of any provision of this chapter or for a violation of any regulation made by the commissioner relating to private shooting preserves. No Change needed.

Sec. 26-48a. Management of salmon, pheasant, turkey and migratory game birds. Issuance of permits, tags or stamps. Change needed to include Sunday Hunting Permit @ $14

Sec. 26-49. Training of hunting dogs. Permits for liberation of artificially propagated birds. No Change needed.

Sec. 26-82. Killing of deer regulated. Damage permit. Jacklight permit. Penalties. Changes needed.

Sec. 26-86a. Game management. Deer hunting; permitted weapons, locations, bag limits. Consent forms; permits, selection process. (a) The commissioner shall establish by regulation adopted in accordance with the provisions of chapter 54 standards for deer management, and methods, regulated areas, bag limits, seasons and permit eligibility for hunting deer with bow and arrow, muzzleloader and shotgun [, except that no such hunting shall be permitted on Sunday]. No person shall hunt, pursue, wound or kill deer with a firearm without first obtaining a deer permit from the commissioner in addition to the license required by section 26-27. ? Remove prohibition.

2004 (Note: Bonus (Replacement) Doe Tags are authorized in Zones 11 & 12 (Primarily all shoreline communities and Fairfield County) as a population management strategy.
